Declaration of Eco-Labelling Form

The Declaration of Eco-Labelling Form is a document designed to gather information, identify, disclose, and manage eco-labels in supporting sustainable waste management, product lifecycle transparency, and environmental accountability. This document serves as a guide for Producer Members to:

  1. Understand the legal requirements under the EPR regulations and associated notices.
  2. Report on, identify and classify eco-labels present on products.
  3. Facilitate the tracking and reporting of eco-labelling information to ensure compliance with the Department of Forestry, Fisheries, and the Environment (DFFE) expectations.

This eco-label assessment is time-sensitive, with a strict deadline of February 28, 2025, for task completion. Meeting this deadline is crucial to advancing our compliance mapping and analysis. Your timely efforts are greatly appreciated.

When to Use This Form:

  • Upon joining ERA as a Producer Member.
  • Annually, as part of ERA’s compliance and governance process.

Regulatory Basis:

The following clauses from the South African EPR Regulation covering the WEEE, Lighting, Battery and Paper and Packaging Notices are directly relevant to eco-labelling:
EPR Regulations:

  • Clause 5.1(z):
    “Implement environmental labels and declaration for the identified products in accordance with SANS 14021 and SANS 14024 within a period of 3 years”.

Use and Storage of Provided Information

Use of Information

ERA will utilise the data submitted by Producer Members to:

  1. Analyse trends and compliance with eco-labelling requirements.
  2. Prepare and report findings to the Department of Forestry, Fisheries, and the Environment (DFFE).
  3. Inform the development and implementation of ERA’s eco-labelling strategy, ensuring alignment with national and international standards, and identify areas for improvement to enhance sustainable practices.

Storage and Protection of Information

  • Confidential Reference File: All submissions will be securely stored in a centralised, protected database.
  • Data Integrity: Submissions will be regularly backed up and monitored to prevent data loss, unauthorised modifications, or unauthorised access.
  • Compliance with Data Protection Laws: ERA will ensure adherence to all applicable data protection regulations, handling Producer Member information responsibly and ethically

Assurance to Producer Members

ERA guarantees that submitted data will only be used for the purposes outlined above and will not be shared with third parties without prior consent, except where legally required by the DFFE.

Types of Eco-Labelling

Eco-labelling involves marking products with labels that provide information about their environmental impact, sustainability features, and recycling options. This practice helps consumers make environmentally conscious choices and promotes transparency in the lifecycle of products.

  • Certified by an independent third party.
  • Indicates that a product has met predefined environmental criteria (e.g., Energy Star, EU Ecolabel).
  • Self-declared environmental claims.
  • Includes statements, symbols, or graphics provided by manufacturers, importers, or retailers (e.g., “Recyclable”).
  • Provides quantified environmental data based on life cycle assessment (LCA).
  • Presented in a standardized format such as an Environmental Product Declaration (EPD).

Labels specific to certain product categories, such as energy efficiency ratings for electrical appliances or hazardous substance warnings.

How to Use this Form

This guide is for Producer Members to complete the Eco-Labelling Form accurately and in compliance with ERA’s requirements under the South African EPR regulations.

Follow these steps:

Step 1: Identify Applicable Products
  • Review your product portfolio to determine which items fall under the scope of WEEE (Waste Electrical and Electronic Equipment), Lighting or Battery categories
  • Focus on products that already have eco-labels or are eligible for eco-label certification.
Step 2: Gather Eco-Labelling Information

For each product, identify the type of eco-label it carries. 

Step 3: Complete the Form
  • List every product with an eco-label in the designated section of the form or upload relevant information via the upload option.
  • Include the following details for each product:
    1. Product Name/Description
    2. Eco-Label Name
    3. Type of Eco-Label (Refer to the classification in the Information Pack)
    4. Certifying Body/Standard
    5. Eco-Label Details (Brief description or certification number, if available)
Step 4: Verify and Submit
  • Double-check the information to ensure accuracy and completeness.
  • If there are products without eco-labels, leave them out of this form but keep a record for future updates or inquiries.
  • Submit the completed form via the ERA website
Step 5: Follow-Up (If Needed)
  • If ERA requests additional details or clarifications, respond promptly to ensure compliance.
  • Use the feedback provided to improve future submissions.
Important Notes:
  • Every product with an eco-label must be listed, regardless of whether it was manufactured locally or imported.
  • The purpose of this form is to ensure compliance with eco-labelling monitoring requirements and promote transparency within the ERA fold.
  • Declaration of Nil Products: Producer Members are required to complete all relevant sections of the form, even if they are not currently using any eco-labels on their products. If no products carry eco-labels, please indicate this by declaring “nil” in the appropriate section. A nil declaration is still considered a valid submission and is necessary to fulfil compliance requirements.
  • Every Producer Member within the ERA fold is expected to submit a declaration, ensuring alignment with the Department of Forestry, Fisheries, and the Environment (DFFE) requirements and contributing to ERA’s comprehensive eco-labelling reporting and strategy.
